I agree, and they went back and forth with that in the movie as well.

In the movie they said that Pilate wanted to wash his hands of the whole thing because he didn't agree that Jesus was guilty of anything - but was forced to act because of public opinion. The other side of the arguement in the movie was that Roman's of the time wouldn't have thought twice about putting someone to death guilty or not if they were causing trouble.
